Terms & Conditions
1. Program Overview
SUNNY provides two types of programs:
Introductory multi-sport programming for children ages 18 months to 6 years in a structured, non-competitive environment. Classes may take place indoors (gymnasium) or outdoors (fields/parks).
Nature exploration + creative learning for children ages 3 years to 6 years in a structured, play-based environment. Classes may take place outdoors (backyard/fishpond) or indoors (household).
SUNNY operates as a sole proprietorship in Alberta, Canada.
2. Registration & Payment
Full payment is required to secure registration.
Registration is non-transferable without written approval.
Spots are limited and filled on a first-come basis.
A minimum number of participants is required for programs to run.
If minimum enrollment is not met, participants will receive a full refund.
3. Refund & Cancellation Policy
Refunds are available up to 7 days prior to program start, minus a $5 administrative fee.
No refunds once the program has commenced.
Missed classes are non-refundable and not transferable.
If a class is cancelled due to instructor illness, facility closure, or unsafe weather conditions, a make-up class or credit will be offered where possible.
4. Assumption of Risk
Parents/Guardians acknowledge that participation in physical activity carries inherent risks, including but not limited to:
Slips, trips, and falls
Collisions with equipment or other participants
Minor injuries such as bruises or sprains
By registering, you voluntarily accept all risks associated with participation in this program.
5. Release of Liability
In consideration of participation, the undersigned parent/guardian:
Releases and holds harmless SUNNY, its owner, instructors, volunteers, assistants, and facility providers from any and all claims, demands, damages, or causes of action arising from participation, except in cases of gross negligence.
Understands that SUNNY carries general liability insurance but that insurance does not eliminate inherent risk.
This waiver is governed by the laws of the Province of Alberta.
6. Medical & Emergency Authorization
Parents/Guardians confirm:
Their child is physically fit to participate.
All medical conditions, allergies, and special considerations have been disclosed.
In the event of injury or emergency, instructors may seek medical treatment if a parent/guardian cannot be reached immediately.
Parents/Guardians are financially responsible for any medical treatment required.
7. Supervision Policy (Ages 18 Months–3 Years)
A parent/guardian must remain onsite during classes for children under age 3.
Parents are responsible for bathroom assistance and personal care needs.
This program is not a licensed childcare or daycare facility.
Children ages 3–6 may participate independently with parent drop-off option if child is potty trained and does not pose any health threats.
8. Behaviour & Safety Expectations
To maintain a safe and positive environment participants must:
Follow instructor directions
Treat others respectfully
Use equipment safely
If unsafe or disruptive behaviour continues after reasonable redirection, the child may be removed from class without refund.
9. Illness Policy
For the safety of all participants please do not attend if your child:
Has a fever
Is vomiting or has diarrhea
Has a contagious illness
No refunds are issued for illness-related absences.
10. Weather Policy (Outdoor Sessions)
Outdoor classes will proceed in most weather conditions unless deemed unsafe due to:
Lightning
Extreme heat
Hazardous air quality
Severe wind or storm conditions
Weather cancellations will be communicated via email/text/social media.
11. Photography & Media Release
Photos or videos may be taken during programming for promotional purposes (website, social media, print materials).
Parents may opt out in writing at registration.
12. Schedule & Instructor Changes
SUNNY reserves the right to:
Modify schedules
Change instructors
Adjust programming as needed
13. Agreement
By completing registration, you confirm:
You have read and understand these Terms & Conditions.
You agree to the Assumption of Risk and Release of Liability.
You are the legal guardian of the participating child.
